Accident Terms and Definitions

Collision Scrub
Occurs during a traffic collision when the downward and rotating forces cause a smearing of tire material on the road surface.

Omnibus hearing
A pretrial hearing normally scheduled at the same time the trial date is established. Purpose of the hearing is to ensure each party receives (or "discovers") vital information concerning the case held by the other.

Injury Rights
Regardless of who is at fault for an automobile accident, your insurance company is responsible for paying your initial medical expenses.

Pedestrian Manifestations
Those items of evidence deposited at the collision scene by the pedestrian during or following impact.

Accident
What auto insurance is designed to cover. Accidents may be considered either at fault or not at fault. If you have at fault accidents on your driving record, your rates will be higher.

Choice no fault
In some state a hybrid no fault system known as " choice no fault " exists. In these states, you may choose to be insured under a strict no-fault plan, in which case you're unable to sue an at fault driver and also can't be sued if you're at fault.

Soft Tissue Injury
Injuries sustained to the muscle, skin, connective tissue.

Excessive speed & Speeding
Speeding is defined as travelling faster than the posted speed limit, or travelling too fast for the road conditions even at speeds under the posted limit.

Blood alcohol testing
At all levels of blood alcohol concentration, the risk of being involved in a crash is greater for young people than it is for older people (Mayhew 1986). In 2001, 25% of drivers ages 15 to 20 who died in motor vehicle crashes had been drinking alcohol (NHTSA 2002b).

Failure to signal
There are laws and driving rules that instruct proper turning signals, at time a hand or a light signal is required to be used. A right hand turn may not be permited, or a turn in an intersection may be done incorectly.

Contact our Omaha Accident Lawyers if you have ever experienced a personal injury and think others are at fault for the accident.

Did You Know?

Car crashes happen at high speeds more often than at low speeds
More than half of fatal crashes occurred on roads with posted speed limits of 55 mph or more, while only 22 percent of property-damage-only crashes occurred on these roads.
